European Commission Preliminarily Finds TikTok in Breach of the Digital Services Act for Failing to Ensure Safe Accounts for Minors
Recently, the European Commission sent TikTok its preliminary findings that accounts belonging to minors do not meet the safety standards required under the Digital Services Act (DSA). TikTok currently allows minors to set their accounts to “public,” potentially making their content accessible to a global audience, including people without TikTok accounts. Content posted by minors aged 16 or 17 may also be recommended to other users through the “For You” feed. The Commission preliminarily considers that content from minors’ public accounts should, by default, be visible only to users accepted by the minor and should not be recommended through the “For You” feed. The findings do not constitute a final decision, and TikTok may examine the case file and respond.

European Commission Updates FAQs on Article 50 Transparency Obligations under the AI Act
Recently, the European Commission updated its FAQs on the transparency obligations under Article 50 of the AI Act, further clarifying the respective responsibilities of AI system providers and deployers and their application in specific scenarios. Providers must ensure that individuals are informed when interacting with an AI system and that AI-generated or manipulated content carries effective, reliable and interoperable machine-readable markings. Deployers must disclose the use of emotion-recognition and biometric-categorisation systems and clearly label deepfakes and AI-generated text on matters of public interest that has not undergone human review or editorial control. These obligations apply from August 2, 2026. For generative AI systems placed on the market before that date, compliance with the content-marking and detection obligation may be deferred until December 2, 2026.
