The bill would require online services, products, or features likely to be accessed by children to implement age estimation or extend children’s protections to all users, provide high-privacy defaults, and restrict profiling, unnecessary data processing, precise geolocation collection, and dark patterns involving children. Businesses would also be required to take reasonable steps to prevent specified physical, financial, psychological, privacy, and discrimination-related harms to children. Violations could result in civil penalties of up to USD 5,000 per affected child for negligent violations and USD 15,000 for intentional violations. The bill subsequently passed both chambers and was enrolled on September 3.
